Attorney Adam Bates Obtains Another Defense Verdict

Attorney Adam Bates recently obtained a total defense verdict for his client following a week-long jury trial. At the time of the accident, Mr. Bates’ client was operating a pick-up truck following behind a farm-implement which caused traffic to slow on a highway. Plaintiff was operating a motorcycle about 4-5 cars further back, when he decided to attempt to pass the line of traffic that had stacked up behind the farm implement. Unfortunately, at the same time, Mr. Bates’ client was making a left-hand turn into a residential driveway. The Plaintiff’s motorcycle collided with the rear of the Defendant’s pick-up truck as it was turning, resulting in catastrophic injuries to the Plaintiff, including multiple broken bones and a traumatic brain injury. Plaintiff requested the jury award him $32 million.

Mr. Bates successfully argued to the jury that the Plaintiff was at fault for the accident; traveling far in excess of the posted 55 mph speed limit, as he left a 106-foot skid mark, and his action of attempting to pass 7 vehicles and a farm implement in and of itself was negligent. The jury found Mr. Bates’ arguments convincing as they returned a verdict in favor of the Defendant, finding the Plaintiff was 60% at fault for the accident, barring any recovery by the Plaintiff.
